Creator Contest Rules | The Cabot Collection

1. Sponsor

Cabot Citrus Farms naming contest (the “Contest”) is open to legal residents:
(i) of the fifty (50) United States and the District of Columbia except Arizona;
(ii) of all of the Provinces and Territories of Canada except Quebec.

who are at least eighteen (18) years old at the time of entry. Employees involved in marketing and communications of Cabot Citrus Farms and in affiliated entities (collectively, “Cabot”) and employees of other companies associated with the promotion of the Contest are not eligible to participate. The Contest is subject to federal, state, provincial, territorial and local laws and regulations.

2. Eligibility

The Contest is sponsored by Cabot Citrus Farms, located at 17590 Ponce De Leon Boulevard, Brooksville, Florida 34614.

3. Contest Dates and Times

Participation in the Contest constitutes entrant’s full and unconditional agreement to and acceptance of these Official Rules and the decisions of the Sponsor, which are final and binding. Winning a prize is contingent upon being compliant with these Official Rules and fulfilling all other requirements set forth herein.

4. How to Enter

The Contest begins on August 17, 2022 at 9 am Eastern and ends on October 30, 2022 at 5 pm Eastern (the “Contest Period”). Entries that are submitted before or after the Contest Period will be disqualified. Submissions will be accepted for the duration of the Contest using the online entry form.

5. Voting

Online: This method of entry will be available by visiting our website (cabotcitrusfarms.com) and following the directions provided to fill out the entry information, and submit.

Limit five (5) entries per person for the duration of the Contest Period. All entries become the property of Sponsor and may not be acknowledged or returned.

Any and all information provided in this Contest is provided to the Sponsor not Facebook or Instagram. The Contest is not sponsored, endorsed or administered by, or associated with, Facebook or Instagram.

6. Contest Prize

On or about November 25, 2022 the Sponsor will select potential winners after a careful deliberation and consideration of all eligible entries received and reviewed by a committee. The odds of having a course or amenity name being selected as the winner depend on the number of entries received and the creativity and applicability of the entered names. The Sponsor will attempt to notify the potential winner(s) via telephone or email on or about November 30, 2022. If a potential winner cannot be contacted within five (5) days after the date of the first attempt to contact him/her, the Sponsor may select an alternate potential winner in his/her place.

7. Odds of Winning

A potential winner will be notified by email, mail or phone. A potential winner will be required to complete, electronically sign and submit a Declaration of Eligibility and Liability/Publicity Release within five (5) days of the date notice or attempted notice is sent, in order to claim his/her prize. If a potential winner cannot be contacted, or fails to submit the Declaration of Compliance within the required time period (if applicable), or prize notification is returned as undeliverable, potential winner forfeits prize. A potential winner must continue to comply with all terms and conditions of these Official Rules, and winning is contingent upon fulfilling all requirements. In the event that a potential winner is disqualified for any reason, Sponsor will award the applicable prize to an alternate winner by carefully considering all remaining eligible entries.

8. Skill Testing Question

The winners of the naming competition will have exclusive access to play the golf course that is the subject of this naming contest. This access will be given during the first week of such golf course’s opening and will be free of green fee charges to the winner and for a friend of the winner. No accommodations are included with this. A gratuitous package of Cabot Citrus Farms apparel will also be given to the winners. The estimated value of each prize does not exceed US$1,500.

9. Winner Selection and Confirmation

In the event that the operation, security, or administration of the Contest is impaired in any way for any reason, including, but not limited to fraud, virus, bug, worm, unauthorized human intervention or other technical problem, or in the event the Contest is unable to run as planned for any other reason, as determined by Sponsor in its sole discretion, the Sponsor may, in its sole discretion, either (a) suspend the Contest to address the impairment and then resume the Contest in a manner that best conforms to the spirit of these Official Rules or (b) terminate the Contest and, in the event of termination, award the prize at random from among the eligible, non-suspect entries received up to the time of the impairment. The Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Contest or to be acting in violation of these Rules or in an unsportsmanlike or disruptive manner. Any attempt by any person to damage the website or undermine the legitimate operation of the Contest may be a violation of criminal and civil law, and, should such an attempt be made, the Sponsor reserves the right to seek damages (including legal counsel’s fees) and any other remedies from any such person to the fullest extent permitted by law. Failure by the Sponsor to enforce any provision of these Rules shall not constitute a waiver of that provision.

10. Evaluation Criteria

There will be one name selected for the golf course and a prize will be awarded to the author of the name. The Sponsor, however, will not be obligated to use the selected name for the golf course. A winning name for the course or for an amenity may be altered at the sole discretion of the Sponsor before it is used but this will not affect the prize to be given. If more than one author submits the same winning name, one winner will be randomly selected to receive the applicable prize.

11. Release and Indemnification

A winner must sign the Sponsor’s Declaration of Eligibility and Liability/Publicity Release form to: (i) confirm compliance with the Contest Rules; (ii) agree to accept the prize as awarded; (iii) release, discharge and hold harmless the Sponsor, its departments and agencies, parent, related and affiliated companies, subsidiaries, franchisees, advertising and promotional agencies, counsel, marketing partners, Facebook, Instagram and each of their respective directors, officers, employees, shareholders, successors, sponsors, partners, licensees, subsidiaries, agents, artists, advisors, assignees, and all others associated with the administration, development and execution of the Contest (”Released Parties”) from and against any and all manner of action, cause of action, claim or demand, loss or injury, use or misuse of a prize or any travel related thereto, and the use of the Entry by the Sponsor, suit, debt, covenant, contract, including legal fees and expenses, whatsoever, including but not limited to, claims based on negligence, breach of contract and fundamental breach, failure of any third-party contractor or supplier used in connection with any aspect of the Contest to perform or deliver any goods or services, any act of God or any other event beyond the Released Parties’ control, any dissatisfaction of any kind by a winner with any aspect of the Contest or any prize, liability for physical injury, death, or property damage that the entrants, guests, their heirs, successors or assigns have, might have or could have suffered, by reason of or arising out of the entrant’s participation in the Contest and/or in connection with the acceptance and/or exercise by the entrant of the Prize as awarded; and (iv) indemnify the Released Parties against any loss, damage or expense, including legal fees, that any of the Released Parties may suffer or incur as a result of any non-compliance by an entrant with any of the Contest Rules or participation in the Contest and/or in connection with the acceptance and/or exercise by an entrant of a prize and the use of the Entry by Sponsor.

12. Other Conditions

Except where prohibited, each entrant agrees that any and all disputes, claims and causes of action arising out of, or connected with, the Contest or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in Florida. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, entrants rights and obligations, or the rights and obligations of the Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the laws of Florida, without giving effect to any choice of law or conflict of law rules, which would cause the application of the laws of any jurisdiction other than Florida.
